HERAEUS AMBA LIMITED LEGAL NOTE AND DISCLAIMER

The Heraeus Amba Web-Site (the "Web-Site") is available for your use on the Terms and Conditions (the Terms) set out below. If you use the Web-Site you will be deemed to have accepted the terms set out below. If you do not accept these Terms, you should immediately discontinue use of the Web-Site.

1. Use of Web-Site

1.1 The information, documents, drawings, illustrations and schematics published on the Web-Site are the sole and exclusive property of Heraeus Amba Limited ("Heraeus Amba"). The copyright and other intellectual property rights in the contents of the Web-Site belong to Heraeus Amba (or to Heraeus Amba's suppliers or contributors to the Web-Site) and nothing in these Terms shall be construed as granting you any right or interest in such copyright and other intellectual property rights.

1.2 You are permitted by Heraeus Amba to view, copy, print, reproduce or store any document or the information contained in any document provided that:-
i) the intended purpose of doing so is with a view to entering into business relations with Heraeus Amba;
ii) the document or any information contained in a document is issued for information purposes only; and
iii) reference to Heraeus Amba as the source of the material must be included in any format through which you use the document and/or information contained within the document.

2 Changes to the Web-Site and these Terms

2.1 Heraeus Amba reserves the right at any time to modify, amend or add to any of the documents or information contained in the documents (including the drawings, illustrations and schematics) on the Web-Site .

2.2 Heraeus Amba reserves the right to modify in any way any of the products published on the Web-Site and/or deliver them in a different engineering design if this is deemed to serve the technological progress.

2.3 Heraeus Amba further reserves the right from time to time to amend, delete or add to any of these Terms. It is your responsibility to review these Terms from time to time to be made aware of the changes. If you do not accept the changes your only remedy is to cease using the Web-Site.

3 Exclusion of Warranty YOUR PARTICULAR ATTENTION IS DRAWN TO THIS CLAUSE WHICH LIMITS HERAEUS AMBA'S LIABILITY

3.1 Information provided on the Web-Site is provided "as is" without any warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose or non-infringement. You should not rely upon any of the information included on the Web-Site.

3.2 No warranty is given as to the reliability, topicality, accuracy or completeness of any information or services provided or referred to in the Web-Site and there may also be technical inaccuracies or typographical errors.

3.3 In no circumstances shall Heraeus Amba be liable for any direct, indirect or other losses which may be suffered by any user of this Web-Site arising out of or in connection with:-
i) the use or existence of all or any part of the Web-Site;
ii) the failure of Heraeus Amba to provide services or information through the Web-Site; or
iii) for damage caused by a computer virus contained in any files downloaded/opened by you.

3.4 If you are not satisfied with any part of the Web-Site, the only recourse you have is to discontinue use of the Web-Site.

3.5 Nothing in these Terms shall be deemed to exclude the liability of Heraeus Amba for death or personal injury resulting from the negligence of Heraeus Amba.

4 Links to other Sites

4.1 The Web-Site may contain links to other Heraeus Amba sites which are subject to further terms and conditions which you will be deemed to have accepted should you use those sites and you are responsible for ensuring that you are aware of any such terms and conditions relating to each web-site.

4.2 Any links to third party web-sites are only for your convenience. Heraeus Amba has no control over those web-sites and it does not accept any responsibility for their contents. The inclusion of a link to another site should not be construed as an endorsement by Heraeus of the relevant site or that Heraeus has any association with the operators of that site.

5 General

5.1 Third Party Rights The Contracts (Rights of Third Parties) Act 1999 shall not apply to this agreement and unless specific provision is made in this agreement to the contrary no person other than the parties to it shall have any rights under it or be entitled to enforce it.

5.2 Entire Agreement These Terms constitute the entire agreement between the parties in relation to the Web-Site and supersede all previous agreements.

5.3 Governing Law These Terms shall be governed by and construed in accordance with AustralianLaw and the parties submit to the non-exclusive jurisdiction of the Australian Courts.
